1. Purpose

These terms and conditions (“Terms”) represent the basis of a contract between you, or the entity on whose behalf you are executing this agreement (“you” or “your”), and JayLens Studio (“JayLens,” “we,” “us,” or “our”). You accept these terms and conditions by corresponding with us, browsing our web properties, or using our Services and agree to abide by them. We may modify these terms and conditions from time to time, and by continuing to use our Services, you agree to be bound by the modifications. 2. Photo Delivery

Photo Delivery Policy: We will typically send a few sneak peaks within a couple of days and will send you a full gallery within fourteen (14) business days. The digital galleries will include high resolution images that are optimized for screen sharing. You will be given instant access to your pictures and will be able to easily download and share them with others! After 30 days you will lose access to your virtual gallery.

3. Video Delivery

Basic Video Package Policy: We typically complete video services within seven (7) business days if the content is provided. The Client will have three (3) business days following the publishing of the video to request edits and provide final approval. Changes requested after the three (3) days will incur a $50 one-time edit fee.

Standard Video Package Policy: We typically complete video services within fourteen (14) business days if the content is provided. The Client will have three (3) business days following the publishing of the video to request edits and provide final approval. Changes requested after the three (3) days will incur a $50 one-time edit fee.

On- Site Video Package Policy: We typically complete video services within twenty-one (21) business days. The Client will have three (3) business days following the publishing of the video to request edits and provide final approval. Changes requested after the three (3) days will incur a $50 one-time edit fee.

4. Deposit and Payment Policy

Deposit and Payment Policy: A non-refundable deposit will be required from the Client before any work commences.
We shall determine the deposit amount and communicate it to the Client in advance. The deposit secures the Client’s session slot in our schedule and enables us to allocate resources and initiate work.

Non-Refundable Deposit: The deposit paid by the Client is non-refundable under any circumstances. We retain the deposit to cover administrative costs, resource allocation, and time spent on session initiation.

Session Cancellation: If the Client cancels the session after making the deposit, we will not refund the deposit amount.
The Client can resume the session within 15 business days from the cancellation date, subject to our availability and the session’s original terms.

Session Rescheduling: If the Client asks to reschedule the session start date after making the deposit, we will transfer the deposit to the new start date. The Client agrees that any subsequent changes to the session start date will not impact the non-refundable nature of the deposit.

5. Disclaimer of Warranty:

We do not provide any warranty or guarantee, whether expressed or implied, regarding the results of our services or the performance of the design work.

6. Limitation of Liability:

You acknowledge and agree that JayLens Studio shall not be liable for any indirect, consequential, or incidental damages arising from the use of our services.

7. Termination

JayLens Studio Termination: We reserve the right to immediately suspend or cancel the session without notice: (a) for your failure to pay any amounts due, or (b) for any disruptive or inappropriate behavior that may compromise the safety, well-being, or professionalism of the session. You are not entitled to notice or protest should we exercise these rights. Upon termination, we will require payment of all due and payable fees. If we terminate your Session because you have violated these terms, you are not entitled to a refund or account credit.

8. Disclaimer of Portfolio

You grant JayLens Studio the non-exclusive right to use, reproduce, and display the photographs taken during the session for promotional purposes, including but not limited to the photographer’s portfolio, website, social media, and marketing materials. However, JayLens Studio respects your privacy, and if you have specific concerns or restrictions regarding the use of certain images, please communicate this in writing prior to the session. We value your trust and aim to showcase our work while respecting your preferences.
